Remediation Permit

Im Sanierungsgebiet besteht nach § 144 Abs. 1 und 2 Baugesetzbuch (BauGB) eine Genehmigungspflicht, die unter anderem Sanierungsmaßnahmen an Gebäuden, den Abschluss von Grundstückskaufverträgen und befristeten Mietverträgen, Grundschuldbestellungen oder die Begründung von Baulasten umfasst.

Measures requiring approval

Measures requiring approval in accordance with § 144 Para. 1 BauGB:

  • Erection, alteration, change of use or demolition of buildings and structures
  • Substantial or substantially value-increasing alterations to land and building structures
  • Transfer of use of a plot of land, building or part of a building under the law of obligations if it is entered into or extended for a limited period of more than one year.
  • Use transfer agreements

Projects requiring approval pursuant to section 144 (2) BauGB are:

  • the legal sale of a plot of land and the creation and sale of a heritable building right
  • the encumbrance of real property (so-called rights in rem), insofar as they are not connected with building measures in the sense of the objectives of the redevelopment
  • the establishment, amendment or cancellation of a building charge
  • the division of a plot of land

Notes on the application

The application for the granting of approval under redevelopment law in accordance with §§ 144, 145 BauGB for projects and legal transactions requiring approval must be submitted in writing to the Urban Redevelopment Department. The second page of the application form contains an information sheet on the documents to be enclosed with the application.

The redevelopment permit according to §§ 144 / 145 BauGB does not replace

  • a building permit in accordance with § 62 of the Thuringian Building Code (BauO)
  • a permit under monument protection law according to § 13 Thuringian monument protection law

Both the building permit and the permit under the law on the protection of monuments may be refused for reasons not relating to redevelopment law.

After receipt of the complete application documents, the processing time is 2 months for all measures for which a building permit is also required, and 1 month for all other measures or projects.

There is no fee for the issuance of the redevelopment permit.

The special urban development law §§ 134 to 164 BauGB is a special law for urban redevelopment and development measures that is limited in terms of subject matter, area and time.
